Schillings specialises in protecting image rights for clients. This term is used to refer to an individual’s proprietary right to their personality – that is the right to prevent unauthorised use of their name, likeness or other personal marks such as physical style, characteristics or signatures.  There is no image copyright law in England expressly prohibiting the use of image rights by other people. However, other laws, such as the laws of passing off, trade marks and defamation, can often be used to achieve an individual’s image protection.  For example, the laws of copyright and/or passing off would prevent someone from copying a celebrity’s signature and using it to illegitimately endorse a product.  We often work with lawyers in other jurisdictions to help clients protect their image rights internationally.
