Statement in open court

A statement in open court is an excellent way of publicising the fact that a newspaper, broadcaster, radio station etc had admitted that they published a defamatory allegation and has apologised to the wronged party.

A statement reflecting the above (the wording of which will either be agreed between the parties or just decided by the wronged party) will be read out in Court.  The media can then report the contents of that statement without risk of being sued for defamation.  This is because statements made in Court, provided that they are reported fairly and accurately, are immune/privileged from defamation actions.

Following a recent case by Schillings, it has now been established that Statements in Open Court can be obtained when a person’s privacy has been infringed and the wrongdoer wishes to apologise.
