Moral rights

Moral rights are a type of intellectual property right.  They include:

  • the right to be identified as the author of a work (e.g. a book or film);
  • the right to object to derogatory treatment of a work; and
  • the right not to have a work falsely attributed to an author/director.

In a claim for infringement of moral rights, in considering what remedies, if any, to grant the Court will take into account any delay in asserting the right.  It’s important, therefore, to act quickly if it is thought there has been an infringement of a moral right.
